Terms of use

These are the terms for using bdrck. They are written in plain English, but they are still a contract between you and [OPERATING ENTITY] — read the disclaimer in section 7 especially closely, because it says what the numbers bdrck produces are and are not.

1. Accepting these terms

You accept these terms when you create an account. We record the version you accepted — currently 2026-09-22 — together with the date and time, against your account. If we make a material change to these terms, we will ask you to accept the new version before you can keep using the service — see section 11.

2. Who may use the service

You may use bdrck if:

  • you are at least 18 years old,
  • you create and keep one account for yourself — accounts are not shared between people, and
  • you use it for your own projects, or on behalf of a business you are authorised to represent.

3. The beta

bdrck is currently in beta, by invite. While it is:

  • It is free to use.
  • Features may change, be added or be removed without notice.
  • Your data may need to be reset — we will tell you beforehand if we expect this.
  • We do not promise any particular uptime. The service depends on council and state government data services outside our control, and it degrades gracefully rather than crashing when they are unavailable, but we cannot guarantee they will always answer.

4. Your licence to use the service

We grant you a personal, non-exclusive, non-transferable licence to use bdrck for your own development-feasibility work, for as long as your account is active and you comply with these terms. We can suspend or end that licence as described in section 10.

5. What you must not do

You must not:

  • share your account or password with anyone else, or let more than one person use a single account,
  • scrape, crawl or bulk-extract data or results from the service,
  • resell, sublicense or otherwise offer the service's outputs as a service of your own to third parties,
  • reverse engineer, decompile or attempt to extract the source code of the service, or
  • use the service in a way that would breach the terms of use of the council or state government data services it queries.

6. Intellectual property

We own bdrck — the software, the design, the planning-rule engine, and everything else that makes the service work. You own what you put into it: the addresses you search, the notes you write, and the assumptions you enter. The reports the service generates from your projects are yours to use for your own projects, including sharing them with lenders, partners and consultants — provided the bdrck attribution stays on the report as generated. Do not remove or alter it; the report is a screening tool and its origin should always be clear to whoever reads it.

7. The disclaimer

bdrck produces desktop screening estimates from third-party data — not a registered valuer’s assessment, and not financial, planning, legal or tax advice. Verify every figure before you rely on it.

bdrck reads state and council spatial services and runs the numbers you enter through a feasibility model. Read that plainly:

  • The underlying data may be wrong. Council and state planning, overlay and cadastre data can be incomplete, out of date, or simply incorrect. We show you where a figure comes from, but we cannot guarantee any of it.
  • Nothing here is a valuation. Nothing produced by bdrck is a valuation for the purposes of the Land Valuation Act 2010 (Qld), or a valuation prepared by a registered valuer. If you need a valuation, engage one.
  • This is not financial product advice. [OPERATING ENTITY] does not hold an Australian Financial Services Licence, and nothing in bdrck is personal or general financial advice.
  • This is not town-planning, legal, engineering or tax advice. It is a desktop screening tool. Assessable use levels, height and density envelopes, and infrastructure charges are our reading of the applicable scheme, not council’s.
  • Verify everything before you rely on it. Every number bdrck produces must be checked with the relevant council, a registered valuer, and your own consultants before you use it to make a decision or enter a commitment — including buying, selling, financing or developing land.
  • You control the commercial assumptions. Construction costs, sale revenue and interest rates are inputs you set (or defaults we suggest); we do not warrant that any of them will hold true for your project.

8. Consumer guarantees and liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded. To the extent the law allows us to limit our liability, we limit it to, at our choice, re-supplying the service or refunding the fees you paid for it in the previous twelve months. In no case are we liable for loss of profit, loss of opportunity, or any decision you make on the strength of bdrck’s outputs — that responsibility sits with you and the professionals you engage under section 7.

9. Subscriptions

bdrck is free during the beta. The terms in this section are drafted now and will apply from the day the first paid plan launches — we are publishing them early so there are no surprises.

  • Plans are billed monthly or annually, at your choice.
  • Prices shown at checkout are GST-inclusive.
  • You can cancel at any time; cancellation takes effect at the end of the billing period you have already paid for.
  • We do not give partial refunds for time left in a billing period, except where the law requires it.
  • If we change our prices, we will give you at least 30 days' notice before the new price applies to you.

10. Suspension and termination

We may suspend or end your access if you breach these terms, if we reasonably believe your account is being misused or shared, or if we are required to by law. Once paid plans exist, we may also suspend access for non-payment. You can stop using bdrck and delete your account at any time from your account page.

11. Changes to these terms

We may update these terms as the product changes. We will give notice of a change through the app or by email, and where a change is material, we will ask you to accept the new version — recorded the same way as your original acceptance in section 1 — before you can keep using the service.

12. Governing law

These terms are governed by the law of Queensland, Australia, and you submit to the exclusive jurisdiction of the courts of Queensland.
